Terms and Conditions for Online Spanish Lessons

Welcome to Ojalá Spanish Academy, where we specialize in providing Spanish language services through effective online tutoring. By browsing and using this website, you signify your agreement to comply with and be bound by the following terms and conditions of use, which govern Ojalá Spanish Academy’s relationship with you regarding our language learning online services. Please do not use our services if you disagree with any part of these terms and conditions.

ACCEPTANCE OF SERVICES AGREEMENT

1. OUR SERVICES


1.1 Ojalá Spanish Academy provides language learning online through convenient online tutoring, making it accessible for both the tutor and the client.


2. OUR OBLIGATIONS AND RIGHTS


2.1 Once the client has pre-paid for any lessons, Ojalá Spanish Academy is committed to delivering the contracted Spanish language services.


2.2 Ojalá Spanish Academy reserves the right to accept, limit, or decline requests for the services offered.


3. RIGHTS OF THE CLIENT/STUDENT


3.1 The student has the right to propose when the lessons might take place, although this agreement must involve a consensus with the tutor.


3.2 The student can choose the pedagogical model that best suits their interest and has total freedom to select or structure the academic content of their lessons.


3.3 The student has the right to cancel or reschedule any 1:1 lesson, within the conditions of clause 9.

GROUP LESSONS

4. ONLINE GROUP LESSONS CLARIFIED


4.1 A minimum of 3 students is required for each group lesson to take place. Typically, the minimum class size for our language learning online sessions is 3, while the maximum is 6.


4.2 Ojalá Spanish Academy cannot guarantee that group lessons will run if they do not meet the minimum student number, which is essential for effective online tutoring.


4.3 Ojalá Spanish Academy reserves the right to cancel any group lesson. If you are enrolled in a cancelled lesson, students will be notified and can choose between a full refund or a free lesson the following month, ensuring our commitment to quality Spanish language services.


4.4 In the event of a student not attending a lesson, this session cannot be made up at another time.


4.5 Group lessons will never be held on a bank holiday. If a lesson is affected by a bank holiday, it will not be charged in your bill.

1:1 LESSONS AND PERSONALISED LESSONS

5. 1:1 LESSONS AND PERSONALISED LESSONS CLARIFIED


5.1 The time and date of the lessons for your online tutoring sessions should be agreed upon mutually, and these should be worked out within the following time frames: from Monday to Friday between 8am and 9pm. This flexibility is ideal for those engaged in language learning online, ensuring a convenient schedule for all.


6. INSTRUCTIONAL MATERIALS EMPLOYED


6.1 The tutor may send you materials for each lesson. No further study materials are required to be purchased for the Spanish language services offered. Although additional resources may be recommended to enhance your learning experience, their purchase is entirely the client’s own decision and at their own risk.

PRICES AND PAYMENTS

7. PRICES


7.1 For current prices of our Spanish language services, please refer to this website or contact us at info@ojalaspanishacademy.co.uk.


7.2 Prices may be modified without prior warning; however, this modification will never be applied to lessons already purchased.


8. GENERAL CONDITIONS AND WAYS OF PAYMENT


8.1 The payment for your online tutoring lessons should be carried out at least 24 hours in advance through the PayPal payment platform or by bank transfer (Bank details will be provided in the pro-forma invoice).


8.2 No cash or cheque payments are allowed unless agreed in writing with Ojalá Spanish Academy.


8.3 No lesson is confirmed until payment has been received.


8.4 Ojalá Spanish Academy cannot take responsibility, nor will take the necessary actions to solve any problem or mistake in the bank transfer the client may have or made.


8.5 Likewise, in the event that the customer has any problem with the payment or misuse of data by the PayPal payment platform, Ojalá Spanish Academy will not be responsible.


8.6 Once payment has been made, and service has been acquired, Ojalá Spanish Academy cannot give any kind of refund (total or partial) for language learning online services.

ONLINE BOOKING AND PAYMENT

The online booking and payment process for our Spanish language services consists of the following steps:  


1) Gather information: The client explores the type of lessons offered at www.ojala-spanishacademy.co.uk, which include options for language learning online.  


2) Complete pre-registration: A contract form will be sent to you, where you should indicate your preferred type of Spanish lesson and availability. When clients inquire about lessons, they are encouraged to take advantage of a free, 30-minute optional assessment lesson. This allows both the student and the tutor to meet face to face and discuss potential online tutoring options.  


3) Pro-firms Proposal: Once the pro-firms proposal has been received, the client can accept it and proceed to make the corresponding payment using the indicated payment method.  


4) Email Confirmation: The client will receive an email confirming that the payment has been made, along with all necessary information for their upcoming lessons.

CANCELLATION POLICY

9. RESCHEDULING OR CANCELLING


9.1 Notice of cancellation or rescheduling of a scheduled lesson for any reason must be given by email to the tutor more than 24 hours prior to the lesson. We cannot accept cancellations by phone, especially for those utilizing our language learning online services.


9.2 Whether the student fails to turn up, or the lesson is rescheduled or cancelled with less than 24 hours’ notice, the usual lesson fee will be billed to the client, which applies to all online tutoring sessions.


9.3 In the event of a student arriving late, the tutor is in his right to choose whether they want to work beyond the scheduled end time or not, ensuring the quality of our Spanish language services.


9.4 Should the tutor not be available for a scheduled lesson, an alternative lesson time will be offered to the client to accommodate their language learning online needs.


9.5 Should the tutor not be available to attend any lesson, either an alternative lesson time will be offered, or a refund of that lesson will be given, ensuring customer satisfaction in online tutoring.

BANK HOLIDAYS

10. HOLIDAYS AND BANK HOLIDAYS EXPLAINED


10.1 Language learning online will not be conducted on bank holidays unless a mutual agreement in writing is made between the client and the tutor.


10.2 Any holidays taken by the tutor providing online tutoring, including those for Spanish language services, will be announced in advance.

DECLARATIONS

11. MINORS AND OTHER VULNERABLE INDIVIDUALS


11.1 Ojalá Spanish Academy only supplies tutors with recent and satisfactory DBS checks, ensuring a safe environment for all students engaged in our language learning online programs.


11.2 In the case of students under the age of 18 years, a responsible adult (apart from the tutor) should be present at all times during the online tutoring sessions. Parents or guardians may choose to leave their child alone with the tutor during lessons. However, this is at their own discretion and risk.


11.3 The tutor is not responsible for the safety, welfare, wellbeing, and care of minors, nor for the protection of any person's property during the Spanish language services provided.


12. PHOTOGRAPHS AND FILMING


12.1 Ojalá Spanish Academy frequently takes photographs of its students to share the language learning online experience and activities. These images may appear in our academy’s prospectus, printed publications, website, or social media platforms. If students do not want their photographs or films used in promotional material or on social media, please notify the tutor. Ojalá Spanish Academy cannot accept responsibility for other students sharing images on social media.
